Welcome to Moment Marker. By accessing or using our AI service (the Service), you agree to be bound by these Terms of Service (the Terms). Please read these Terms carefully before using the Service.

By using our Service, you agree to:

• Not attempt to circumvent any technical limitations or security measures.
• Not use the Service for any illegal or unauthorized purposes.
• Not interfere with or disrupt the Service or the servers and networks it relies on.
• Not generate content that infringes on third-party intellectual property rights or contains harmful or illegal material.

You are solely responsible for the text, images, or other content (User Content) that you provide to the Service. You agree not to provide User Content or generate content that:

• Violates any applicable laws or regulations.
• Is hateful, defamatory, discriminatory, or threatening.
• Infringes on the intellectual property rights of others.
• Is sexually explicit, pornographic, or depicts nudity.
• Is intended to harass, abuse, or harm others.

You retain all intellectual property rights to the images you create using our Service. You grant us a limited license to host your content to provide you with the Service. You are solely responsible for ensuring that your input and the generated content do not infringe on any third-party rights.

The Service generates content using artificial intelligence. This content is novel and generated based on your inputs, but we cannot guarantee that it will be unique or that similar content has not been or will not be generated for other users. We make no claims about the copyright status of generated images.

We offer various subscription plans, including Free, Basic, and Pro tiers. By subscribing to our paid plans, you agree to pay the subscription fees displayed on the pricing page.

Subscription fees are billed on a monthly basis. Your subscription will automatically renew unless you cancel it before the end of the current billing period. You can manage or cancel your subscription at any time in your user dashboard.

Cancellations will take effect at the end of the current billing period, and you will have access to the service until that date. To the extent permitted by applicable law, payments are non-refundable. We may provide a refund or credit on a case-by-case basis at our sole discretion, and a provision of a refund or credit in one instance does not entitle you to a refund or credit in the future.

Payments are processed securely by Creem, our third-party payment processor. By making a purchase you consent to Creem processing your payment information in accordance with its privacy policy (https://creem.io/privacy).

If you believe you have been charged in error, contact us at [email protected] within 14 days. We will investigate and, when appropriate, issue a refund via our payment processor Creem in accordance with its refund policies.

Our privacy practices are outlined in our Privacy Policy. To provide and improve the Service, we collect your registration information (e.g., email address) and may store your user prompts and generated content. We are committed to taking reasonable security measures to protect your data.

While we strive to provide a continuous and stable service, we do not guarantee that the Service will be uninterrupted or error-free at all times. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

The Service is provided as is without any warranties, express or implied. To the fullest extent permitted by law, we shall not be liable for any damages arising from the use or inability to use the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

We reserve the right to modify these Terms at any time. All revisions will be posted on this page, and we will notify you of material changes through appropriate means. Your continued use of the Service after any revisions are posted constitutes your acceptance of the new Terms.
